General terms and conditions for the store of Masterhomepage GmbH

 (1) Scope of application
The following terms and conditions apply to all software products provided by Masterhomepage against payment.

(2) Subject of the terms and conditions
Masterhomepage operates an online store for commercial purposes under the domain https://www.shop.masterhomepage.ch, in which mainly software products are offered for purchase via the Internet.

(3) Duties of the customer
The customer has to provide all data required for the proper purchase transaction completely and truthfully during the registration. The customer is responsible for the information provided and its correctness.

(4) Right of withdrawal
Software products that are offered for immediate download are excluded from the right of revocation.

(5) Fees, Billing, Terms of Payment
The current prices for the modules can be seen in the store. All prices stated are net prices and do not include the statutory value added tax. The user is obliged to pay for the purchased products at the indicated prices. Properly registered users who have retrieved paid products will receive an invoice after successfully completing the purchase process, and the invoice will be sent by e-mail. Masterhomepage accepts only the payment methods offered in the store.

(6) Copyright and copyrights
The software products distributed by Masterhomepage are protected by copyright. The user agrees to recognize and respect the copyrights. No copyrights, rights of use or other protective rights to the software products are transferred to the user. The user is only entitled to use the software products for his own purposes. He is not entitled to make the software products available on the Internet, in intranets, in extranets or otherwise to third parties for exploitation. Public reproduction or other further publication and commercial duplication of the software products is expressly excluded. The user may not remove copyright notices, trademarks and other legal reservations in the retrieved software product.
All modules for which a fee is charged are licensed for use on one domain. If the customer wants to use offered modules for different domains, a separate license must be purchased in each case.

(7) Terms of payment
Unless otherwise agreed in writing, payment of the total amount for the creation order shall be made as follows: Fifty percent of the invoice amount when the order is placed and fifty percent of the invoice amount when the homepage is completed. Later changes will be paid in full after completion.

(8) Warranty/Liability
The use of the modules is the sole responsibility of the user.
Further claims of the user, especially for loss of profit or consequential damages, are excluded, as far as Masterhomepage did not act grossly negligent or intentionally. Especially for the modules of third party providers Masterhomepage does not assume liability and support. Inquiries concerning problems with these modules are to be made directly to the developer.

(9) User ID and Password
The safekeeping and use of his access data to the online store of Masterhomepage is the sole responsibility of the customer. Masterhomepage is not liable for any damage caused to the user by misuse or loss of the access data assigned to him or deposited by him.

(10) Data protection
The user is hereby informed that Masterhomepage stores his complete address as well as other user data provided by him and treats them confidentially.
With the registration the user agrees that his email may be used for information about the update of the product offer. The consent can be revoked at any time by informal communication. Your data will not be passed on to third parties or used for advertising purposes of third parties.

(14) Place of performance and jurisdiction
The law of the country in which our registered office is located (Switzerland) shall apply, to the exclusion of the UN Convention on Contracts for the International Sale of Goods, even if orders are placed from abroad or deliveries are made abroad. If the customer is domiciled or habitually resident abroad, the place of our registered office is the place of jurisdiction for all claims in connection with the order or service. We are also entitled to take legal action at your general place of jurisdiction.

(15) Effectiveness
Should individual passages of the GTC be invalid under applicable law, all other passages shall remain valid. With the appearance of the updated GTC, older versions lose their validity.
